Terms and Conditions

Article 1. Definitions

Article 2. General Provisions

  1. These Terms and Conditions are the terms referred to in Article 8 of the Law on the provision of services by electronic means.
  2. These Terms and Conditions constitute the Seller’s performance of its obligation under Article 12 of the Consumer Rights Act.
  3. Customers may access these Terms and Conditions at any time via a link on the store’s homepage and download and print them.
  4. All deadlines should be calculated in accordance with Article 111 of the Civil Code, i.e., a period expressed in days ends at the end of the last day, and if the beginning of the period, expressed in days, is a specific event, the day on which this event occurred is not counted when calculating the period.
  5. The Seller informs about known warranties provided by third parties for goods available in the store.
  6. All comments and feedback on the store’s operation and its various functions can be directed in writing, by phone, or by email using the Seller’s contact details. The Seller must respond to any complaints within 14 days of receipt and inform the Customer about further actions.
  7. The Buyer shall:
    1. not provide or transmit content prohibited by law, such as content that promotes violence, defamatory, or infringes on personal rights and other rights of third parties,
    2. use the store in a way that does not disrupt its operation, especially through the use of specific software or devices,
    3. not carry out actions such as: sending or posting unwanted commercial information (spam) in the store,
    4. use the store in a way that is not burdensome for other Customers and for the Seller,
    5. use any content posted in the store exclusively for their own use,
    6. use the store in a manner that complies with the provisions of the applicable law of the Republic of Poland, the provisions of these Terms and Conditions, as well as general netiquette principles.

Article 3. Technical Conditions

  1. To fully utilize the store, the Buyer must meet the following technical requirements:
    1. Have access to the Internet;

To access the store, make sure your web browser is up-to-date: IE version 9 or later, Firefox version 3 or later, Opera version 9 or later, Chrome version 10 or later, Safari with the latest JAVA and FLASH versions installed, on screens with a horizontal resolution above 640 pixels. Disabling third-party software that affects the functionality of browsers like Internet Explorer, Firefox, Opera, Chrome, and Safari may impact the correct display of the store, so they should all be disabled for full functionality.
You need an email address to create an account in the store.
Having an active phone number is required for creating an account in the store.
**4. Services provided through means of electronic communications**
The seller allows the use of services provided through means of electronic communications via the store for each user to: view content provided in the store, create a Buyer’s account in the store, place orders and conclude sales contracts through the store, news subscription service, product availability notification service, view order history.
**5. Creating an account in the store**
No account is needed to view store content. An agreement on the provision of services through means of electronic communications is concluded between the Buyer and the Seller as soon as the Buyer enters the store’s website address in the Internet browser or is redirected to the store’s website. Leaving the store’s website terminates the agreement.
At the moment of creating an account in the store, an agreement regarding the provision of services through means of electronic communications for creating an account is concluded between the Seller and the Buyer. This agreement is concluded for an indefinite period.
Account creation is possible after acquainting and accepting the content of these Terms and Conditions.
**6. Placing an order**
Orders can be placed 24 hours a day.
Orders can be placed by Buyers with an account in the store and those without an account.
To place an order, the Buyer must go through the following steps, some of which may be repeated: adding the product to the cart, selecting the type of delivery, choosing the method of payment, choosing the product pick-up location, placing the order using the “Order with obligation to pay” button.
Confirmation of the order by sending to the specified email address: order, invoice, withdrawal right information, these Terms and Conditions in pdf format, sample withdrawal form in pdf format, links to download these Terms and Conditions and the sample withdrawal form separately.
**7. Right of withdrawal**
Consumers have the right to withdraw from a distance contract within 14 days without stating a reason or incurring additional costs, except as provided by law.

  • When the “NOTIFY ME” button is clicked, an agreement is concluded between the Seller and the Buyer for the provision of services by electronic means. The agreement is concluded for a specified period in section 5.
  • The service will be active until the first notification is sent, but not longer than 2 years from the date of the request for notification of the availability of the goods.
  • An email notification of the availability of the goods will be sent to the provided address no later than 1 day after the goods become available.
  • The activation of the service does not constitute a reservation of the goods, priority right to purchase the goods, or in any way guarantee the possibility of purchasing the goods in the future under any conditions.
  • The activation of the service includes the processing of personal data by the Seller regarding the email address and expected goods, exclusively to perform this service and provide information on the availability of the expected goods.
  • Disabling the service is possible at any time by contacting the Seller.

Privacy and Data Security Policy

  1. The Controller of customers’ personal data of the Store is the Seller.
  2. The Seller agrees to protect personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), the Act of 10 May 2018 on the protection of personal data, and the Act of 18 July 2002 on the provision of electronic services.
  3. Details of the processing of personal data by the Controller in the Store are described in the Privacy Policy.

Dispute Resolution Option

  1. Consumers, if interested, may use alternative dispute resolution procedures. Disputes related to online purchases may be resolved through mediation procedures before the Voivodeship Trade Inspection Authority or court proceedings before the Arbitration Court at the Voivodeship Trade Inspection Authority. Consumers can also use other methods of alternative dispute resolution and, for example, submit their complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/
  2. If the Consumer is not interested in using the alternative dispute resolution option, the resolution of all disputes arising between the Seller and the Consumer will be referred to competent courts in accordance with the relevant provisions of the Civil Procedure Code.
  3. The resolution of all disputes between the Seller and the Buyer and the Buyer with Consumer Status will be referred to a court having jurisdiction over the location of the Seller.

Final Provisions

  1. Registered Buyers will be notified of changes to the Terms and Conditions and their scope by email (to the email address provided during registration or when placing an order). Notification will be sent no later than 7 days before the new Terms and Conditions come into effect. Changes will be made to align the Terms and Conditions with current legislation. In the event of disagreement with the changes in the Terms and Conditions, the Buyer has the right to terminate the agreement for the provision of services by electronic means and delete the account.
  2. The current version of the Terms and Conditions is always available to the Buyer in the Terms and Conditions tab. During the order execution and throughout the entire post-sales period, the Buyer must comply with the Terms and Conditions accepted by the Buyer when placing the order, except where the Consumer deems them less favorable than the current ones and informs the Seller of choosing the current ones as mandatory.
  3. Nothing in these Terms and Conditions is intended to violate the rights of the Buyer. No provision can be construed so that in case of discrepancy with any part of the Terms and Conditions to prevailing law, the Seller declares their absolute compliance and the application of this law instead of the challenged provision of the Terms and Conditions.
  4. Questions not regulated by these Terms and Conditions are subject to applicable law.

Personal Data

In accordance with the definition established in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as GDPR, “personal data” means any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

§ 2. Personal Data Controller

The Controller of Users’ personal data is INDIGO NAILS sp. z o.o. with the registered office at Senatorska 14/16, 93-192 Lodz, Poland, registered in the Entrepreneurs Register kept by the Lodz-Śródmieście District Court in Lodz, 20th Commercial Division of the National Court Register under KRS number: 0000684415, holder of the following VAT number: 7272792881 and National Official Business Registry number (REGON): 101805889.

§ 3. Collection of Personal Data

  1. We collect personal data during:

1) subscribing to newsletters;

2) creating an account on the Website;

3) placing orders (for Users without an account on the Website).

  1. When subscribing to newsletters, we collect the following personal data: email address.
  2. When filling out the account registration form, we collect the following personal data: name, surname, email address, telephone number, and billing address.
  3. When placing orders by Users without an account on the website, we collect the following personal data: name, surname, email, telephone number, and shipping address.

§ 4. Purpose of Personal Data Collection

  1. Personal data collected when subscribing to newsletters is collected for conducting marketing activities towards Users, including for analytical and statistical purposes.
  2. Personal data collected when creating an account on the Website is processed for the following purposes:
  • concluding and performing an agreement on the provision of electronic services, i.e., providing the User with the opportunity to use our Website;
  • concluding and performing a distance sales contract concerning goods available in our online store;
  • investigating and handling complaints that may be filed in connection with the purchase of goods in our online store;
  • defending against or objecting to claims arising from the conclusion of the aforementioned contracts;
  • marketing products and services, including analytical and statistical purposes;
  • contacting Users, including purposes related to permitted marketing activities, via available communication channels, especially, and with the consent of Users – by email and phone;

§ 5. Transfer of Personal Data

  1. Personal data of Users collected by us may be transferred based on an agreement on the processing of personal data to contractors assisting us in concluding and performing the aforementioned contracts, as well as in defense or objection to claims, in the performance of obligations arising from statutory provisions, and supporting us in providing marketing services, including, in particular: legal, tax, and accounting assistants, research agencies working on our behalf, Polish Post, courier companies, IT service providers, marketing agencies, as well as legal and capital-related entities associated with us and our business partners.
  2. With the consent of the User, their personal data may be transferred to our affiliates and business partners for direct marketing of their products and services.
